    1. Acceptance of Terms. Please read very carefully these terms and conditions. Accessing any page or service provided by TTiqq indicates that you agree to abide by the terms and conditions. Access to any TTiqq page or service is not permitted to those who do not agree to ALL terms and conditions. At its sole discretion, TTiqq reserves the right to make revisions to the terms and conditions at any time without further notice. You are solely responsible to check and review any updates to the terms and conditions on a consistent basis. By continuing use of the site and service after any such changes constitutes your acceptance of the new Terms and Conditions.


    2. Personal Use. The Service is made available to you for your personal use only. TTiqq is intended solely for users who are thirteen (13) years of age or older, and any registration by, use of or access to the site or service by anyone under 13 is unlicensed, unauthorized and in violation of these Terms and Conditions. You must provide current, accurate identification, contact, and other information that may be required as part of the registration process and/or continued use of the Service. You are responsible for maintaining the confidentiality of your Service password and account, and are responsible for all activities that occur thereunder. TTiqq reserves the right to refuse service, terminate your membership, delete your profile and any content you posted on the Site and/or prohibit you from using or accessing the Service or the Site, for any reason, at any time in its sole discretion, with or without notice. TTiqq may also impose restrictions on particular features and services or restrict your access to parts or all of the Services without notice or liability. Additionally, TTiqq reserves the right to suspend or discontinue the Services, including any content and the availability of any feature, for any reason, at any time.


    3. Proper Use. You agree that you are responsible for your own communications and for any consequences thereof. Your use of the Service is subject to your acceptance of and compliance with the Agreement. The Site and Service are available for your personal, non-commercial use only. It is strictly prohibited to register for more than one User account, register for a User account on behalf of a separate individual, group, or entity. You agree never to create a false identity, use another's account, impersonate any person, group or entity, or falsely represent yourself, your age or your association with any person, group, or entity. You agree that you will use the Service in compliance with all applicable local, state, provincial, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to: (i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory, libelous, harassing, abusive, pornographic, fraudulent, obscene, private, contains viruses, or is otherwise objectionable as reasonably determined by TTiqq; (ii) upload, transmit or otherwise distribute content that infringes upon another party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iii) act in any manner that could damage, disable, overburden or impair the Site, thus preventing others from using the Service; (iv) use the Service for any fraudulent or inappropriate purpose; or (v) act in any way that violates the Program Policies, as may be revised from time to time. Additionally, You agree never to harvest or collect any contact information of Users from the Service or the Site by electronic or other means for the purposes of sending any type of unsolicited communications. Furthermore, you agree never to use automated scripts to collect information from the Site or service for any purpose. Violation of any of the foregoing may result in immediate termination of this Agreement, and may subject you to state, provincial, and federal penalties and other legal consequences. TTiqq reserves the right, but shall have no obligation, to investigate your use of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any applicable law, regulation, legal process or governmental request.


    4. Your Intellectual Property Rights. TTiqq does not claim any ownership in any of the content, including any text, data, information, images, photographs, music, sound, video, or other material, that you upload, transmit or store in your TTiqq account. TTiqq reserves the right to, but is not obligated to review and remove any user content without notice, that in the sole judgment of TTiqq, violates this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of others. TTiqq will not use any of your content for any purpose except to provide you with the Service. Through the action of uploading, submitting, disclosing or distributing any type of content at or on the site, or through the Services, unless you have quoted a source, you represent and warrant that you own all rights in the content. You also agree that any content you upload, submit, disclose or distribute will be subject to the Creative Commons Public Domain License.


    5. Representations and Warranties. You represent and warrant that (a) all of the information provided by you to TTiqq to participate in the Services is correct and current; and (b) you have all necessary right, power and authority to enter into this Agreement and to perform the acts required of you hereunder. You understand and acknowledge that TTiqq has no control, makes no representations, and is not responsible or liable in any manner to take any action with respect to: accuracy, decency, legality, copyright compliance of any user or third party content posted on the site or associated with the service; the users participating on the Site; online or offline conduct of any user of the site or service; the effects the content may have on you; your interpretation or use or use of the content; or any actions you may take as a result of having been subjected to the Content. You agree to release TTiqq of all liability for you having being subjected, or not subjected to content through the site or service. The site, content, and service are all provided "AS IS", without warranties or representations of any kind, either implied or express, including without limitation, implied warranties or conditions of fitness for a particular purpose, non-infringement, merchantability.


    6. Privacy. As a condition to using the Service, you agree to the terms of the TTiqq Privacy Policy, which is available here: Privacy Policy. By accessing this site and service, you consent to have your personal data sent and processed in Canada.


    7. Copyright Policy. You agree never to post, modify, distribute, or reproduce in any shape or form, any copyrighted material, trademarks, or other proprietary information that does not belong to you, without obtaining prior written consent from the owner of such proprietary rights. Membership privileges will be revoked if any user continuously infringes the copyright rights of others upon receipt of proper notification to TTiqq by the copyright owner or their legal agent. If you feel that material posted on the TTiqq site or service constitutes copyright infringement, provide TTiqq notice by written communication to the attention of "Copyright Infringement Notification" care of abuse@ttiqq.com that sets forth information specified by the Canadian Copyright Act. TTiqq will promptly process and investigate notices of alleged infringement and will act under the Canadian Copyright Act and other applicable intellectual property laws. Be advised that you may be liable for damages, which includes costs and attorneys' fees, if you materially misrepresent a copyright infringement claim.


    8. User Disputes. You are solely responsible for your interactions with other TTiqq users. TTiqq reserves the right, but has no obligation, to monitor disputes between you and other users.


    9. Indemnification. You agree to indemnify and hold TTiqq, its subsidiaries, and affiliates, including their respective vendors, officers, agents, partners, customers, contractors, directors, and employees from any loss, liability, demand, claim, expenses (which include attorney's fees), litigation costs, damage (actual and consequential), suits, judgments, and costs, made by any 3rd party due to or arising out of your access to the TTiqq site or service, connection with any user content or third party content you post or share on or through the site, breach of the Terms of Conditions by you, or the infringement by you, or any 3rd party using your TTiqq account, violation of any law or the rights of any 3rd party, or your conduct in connection with other users of the TTiqq site or service, or with the TTiqq site or service.


    10. Links. Due to the nature of the service provided by TTiqq, links to other web sites and/or resources may be provided. Such 3rd party sites and associated content are not monitored or checked for accuracy, and appropriateness. You acknowlege and agree that, since TTiqq has no control over such sites and resources, TTiqq is not responsible in any way for the availability of external sites or resources, and does not endorse, approve, is not responsble or liable for any content, products, advertising or any other material available from 3rd party sites or resources. If at any time, you decide to leave the TTiqq site and access any 3rd party sites or services, TTiqqs terms and policies no longer govern. Additionally, you acknowledge and agree that TTiqq is not liable or responsible, indirectly or directly, for any loss caused, damage, or alleged to be caused by or in connection with use of any such content, services or goods available on or through any 3rd party site or resource.


    11. Limitation of Liability. In no event shall TTiqq, its employees, or suppliers be liable to you or any 3rd party for any exemplary, indirect, consequential, incidental, special or punitive damages, or any other damages of any kind, substitute goods or services, including for any lost profits or data as a result of your use of the site or service or any site content or other materials on or accessed through the site or service, even if TTiqq is aware of has been advised of potential damages. Notwithstanding anything to the contrary contained herein, TTiqq's liability to you for any cause whatsoever, and regardless of the form of the action, will at times be limited to the amount paid, if any, by you to TTiqq for the service during the term of membership, but in no case will TTiqq's liability to you exceed $100. Furthermore, you acknowledge that if no fees are paid to TTiqq for use of the site or service, you shall not be entitled to damages of any kind from TTiqq, regardless of the cause of action.


    12. Miscellaneous. You acknowledge that you do not have any authority of any kind to bind TTiqq in any respect whatsoever. TTiqq is not responsible or liable for any failure to perform its obligations in cases which result from any cause, determined by TTiqq at its sole discretion, beyond TTiqq's control. The TTiqq site and/or service may be temporarily unavailable due to unforeseen occurances. TTiqq assumes absolutely no responsibility for any omission, error, interruption, defect, deletion, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, User communications. Furthermore, TTiqq is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to Users or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service. Under no circumstances is TTiqq responsible for any damage or loss, including any damage or loss to any user content or personal injury or death, resulting from anyone's use of the TTiqq site or service, any user content or 3rd Party Content posted on or through the TTiqq site or service or transmitted to users, or any interactions between users of the TTiqq site or service, whether online or offline. If any provision of the Terms and Conditions is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms and Conditions shall otherwise remain in full force and effect and enforceable.
